Legal Background

SB22-217 transferred responsibilities for the Disabled Parking Education Program, 42-1-227 C.R.S., to the Colorado Disability Funding Committee. The Colorado Council for People with Disabilities previously administered this program until it was eliminated in HB20-1392. 

The Disabled Parking Education Program utilizes revenue from disability parking violations to educate the public, law enforcement, local governments, medical professionals, parking operators, and tow operators on the importance of proper use of parking reserved for people with disabilities. 

The Colorado General Assembly declared disability parking a matter of statewide concern, 42-4-1208(7) C.R.S. State and local authorities issuing citations or violations of disability parking are required to transfer one-half of the fine to the disabled parking education and enforcement fund, 42-4-1208(6)(k) C.R.S. Additionally, fines for disability parking violations are established at:

  • $150 and a surcharge of $32 for violations of 42-4-1208(3)(b), 3(c), and 3(d), 42-4-1701(4)(a)(I)(M) C.R.S. 
  • Violations of 42-3-204 (7)(f)(II) or 42-4-1208 (3)(a), (3)(a.5), or (4) are, in accordance with 42-4-1701(4)(a)(VIII) C.R.S., a class A traffic infraction with a surcharge of $32 and:
    • A fine of not less than $350 but not more than $1,000 for the first offense;
    • A fine of not less than $600 but not more than $1,000 for a second offense; and
    • A fine of not less than $1,000 but not more than $5,000, in addition to not more than ten hours of community service, for a third or subsequent offense.

Additionally, a person who violates section 42-4-1208(3) by parking a vehicle owned by a commercial carrier commits a class A traffic infraction, in accordance with 42-4-1701(4)(a)(IX) C.R.S.; a person who violates section 42-4-1208(5) commits a class A traffic infraction in accordance with 42-4-1701(4)(a)(X)(A); and a person who willfully receives remuneration for violating section 42-4-1208(5) commits a class A traffic infraction, in accordance with 42-4-1701(4)(a)(X)(B).

Information for Municipalities

The Committee requests reporting from all Colorado entities that issue fines for violations of disability parking regulations and has created a simple form for this reporting.
